  15. An act relating to radio communication; creating ss. 125.0185 and 166.0435, F.
  16.       S.; prohibiting  counties and municipalities from  enacting or enforcing
  17.       restrictive ordinances  governing amateur radio  antenna; providing  for
  18.       construction of such antennas  in conformance with federal requirements;
  19.       providing for the applications of the act; providing an effective date.

  21.             Be It Enacted by the Legislature of the State of Florida:
  22.  
  23. Section 1.  Section 125.0185, Florida Statutes, is created to read:
  24.  
  25. 125.0185   Amateur radio  antennas; construction  in conformance  with federal
  26. requirements.
  27.  
  28. (1)  No county shall enact or enforce  any ordinance or regulation which fails
  29. to  conform to the limited preemption entitled ``Amateur Radio Preemption, 101
  30. FCC  2d 952 (1985)'' as issued by  the Federal Communications Commission.  Any
  31. ordinance or  regulation adopted  by a county  with respect  to amateur  radio
  32. antennas shall conform  to the  above cited limited  preemption, which  states
  33. that local  regulations  which  involve placement,  screening,  or  height  of
  34. antennas  based on health, safety, or aesthetic considerations must be crafted
  35. to reasonably accommodate amateur communications and to  represent the minimum
  36. practicable regulation to accomplish the local authority's legitimate purpose.

  38. (2)  Nothing in this section shall effect any applicable provisions of chapter
  39. 333.

  41. Section 2.  Section 166.0435, Florida Statutes, is created to read:
  42.  
  43. 166.0435   Amateur radio  antennas; construction  in conformance  with federal
  44. requirements.
  45.  
  46. (1)  No municipality shall enact  or enforce any ordinance or regulation which
  47. fails  to  conform   to  the  limited  preemption   entitled  ``Amateur  Radio
  48. Preemption,  101 FCC 2d 952  (1985)'' as issued  by the Federal Communications
  49. Commission.   Any  ordinance  or regulation  adopted  by a  municipality  with
  50. respect to  amateur radio antennas  shall conform  to the above  cited limited
  51. preemption,  which  states that  local  regulations  which involve  placement,
  52. screening,  or  height  of antennas  based  on  health,  safety, or  aesthetic
  53. considerations  must  be  crafted   to  reasonably  accommodate  amateur  com-
  54. munications and to represent the minimum practicable regulation to  accomplish
  55. the local authority's legitimate purpose.
  56.  
  57. (2)  Nothing in this section shall effect any applicable provisions of chapter
  58. 333.
  59.  
  60. Section 3.  This act shall take effect upon becoming a law.
